State Dismissed All Charges on DUI with .160/.140 BAC

By thoroughly interviewing the police officers involved, Rachelle Ferraro was able to discovery lapses in the memory of the officers regarding the processing of Client, potential legal issues with how the breath test was administered as well as potential problems with the Intoxilyzer breath testing machine used. After frank conversations with the Prosecutor about the State's problems with the case, the State voluntarily dismissed all charges.
Throughout the pretrial investigation of the case, the arresting officer (DPS) commented on Rachelle Ferraro's thoroughness and ultimately advised he would utilize her services if he ever needed an attorney.
As charged, Client had been facing a mandatory minimum sentence of thirty (30) days in jail; significant fines; alcohol counseling; and one year of ignition interlock if convicted of an extreme DUI (above .150).
Instead all charges were dismissed.
