
How Can I be Convicted of Driving Under the Influence if I am Not Under the Influence?
Arizona DUI Laws do not only criminalize driving while a person's ability to drive is impaired by alcohol or drugs. Instead, they also can criminalize driving while a person is unimpaired but has the metabolite or remnants of a medication or a drug in their system. While it is a defense if the medication was ingested pursuant to valid prescription, there is no defense if the medication or drug was legally ingested in a location that did not require a prescription but remains in your system after you have left that other location.
