Probation Obtained in "Dangerous" Aggravated Assault case where gun was pointed at and fired at another person

A verbal altercation became physical when client pointed and fired gun at an unarmed person. The police and prosecutor did not believe client's fear for his safety was legitimate or warranted the threat of or discharge of the gun because the other person was unarmed. Nevertheless multiple pretrial issues and Special Action litigation in the Court of Appeals resulted in a probation plea offer to resolve the case. Given the 5-15 years of mandatory prison client was facing if convicted, the probation plea was a substantial victory.
