State Dismissed Case in the middle of trial
January 2019
In a lengthy cross examination (which had lasted over an hour and was not yet completed), the alleged victim admitted lying to counsel and to the police. The Court, who had already advised the alleged victim of her right to remain silent, was on a recess determining if it would appoint her a lawyer. While the Court was on recess, the alleged victim refused to continue to be questioned and left the courtroom and courthouse mid trial. The State had to dismiss the case. The dismissal was granted with prejudice so charges cannot be refiled.
